Terms and Conditions

SUMMARY: By commissioning me you confirm you’re an adult. I take a non-refundable, two-step payment (sketch then final). You get up to two free revisions. Default license is personal (non-commercial). Final PNG delivered at your chosen orientation — Landscape 5120 × 2880 or Portrait 3400 × 5100 — via chat or a download link.
AGREEMENT & ELIGIBILITY- Eligibility: By commissioning the Artist the Client confirms they are a legal adult in their country.- Acceptance: The Artist may decline or request modifications to any commission request depending on its specifics. The Artist will provide an explanation when practicable.- Agreement: Communications on the agreed platform(s), the Client’s tier/option selection, and payment collectively constitute the agreement for the commission — the Client should retain copies of messages and receipts as a record.- Consent: By commissioning or tendering payment the Client accepts these terms.
PAYMENT & CANCELLATIONS- Payments: All commissions are non-refundable. Payment is divided into two instalments: 1) upon delivery of the sketch, and 2) prior to delivery of the final file. In exceptional circumstances the Artist may request earlier or full payment; the Client may decline and the commission will proceed with the standard split.- Refunds & cancellations: Payments are non-refundable. If the Client cancels prior to final delivery the Artist will retain received payments. If the Artist cancels a commission the Artist will refund any unused portion. Refunds are otherwise issued only in exceptional circumstances (e.g., billing errors).- Payment platforms & fees: The parties will agree which acceptable payment method will be used for each commission. Listed prices include transaction fees; the Client will not be charged additional fees unless the commission’s scope or deliverables require extra items or services.
DELIVERY & REVISIONS- Revisions: The Client is entitled to up to two complimentary revision rounds (minor + minor or minor + major) prior to final payment. Additional or post-completion alterations may be offered at the Artist’s discretion and may incur additional fees.- Deliverables & orientation: The Client must specify the desired orientation when placing an order: Landscape (16:9): 5120 × 2880 or Portrait (2:3): 3400 × 5100. In the absence of specification, the Artist will default to Landscape. The final file will be delivered as PNG.- Delivery method: The Artist will deliver files via the agreed communication platform when technically feasible. If platform limitations prevent direct delivery the Artist will provide a download link or another mutually agreed method.- Turnaround & communication: The Artist undertakes commissions according to their schedule. The Artist will notify the Client of delays when they occur; the Client may request an estimated delivery date.- Source files: The Artist does not provide source or working files (e.g., PSD) unless explicitly agreed in advance.- Content & scope: The Client should not expect the Artist to produce items listed under the "What I won't draw" section. Significant scope changes — such as additional characters, major redraws, or substantial background revisions after a quote — may require a revised quote and additional payment.
RIGHTS & USE- License rules: The Licenses section (including all subsections) governs licensing, exclusivity, revenue‑verification, and license‑term rules and is incorporated into these Terms.- Rights & license: The default purchase grants a Personal (non-commercial) license only. Commercial use requires the separate purchase of a commercial license. Linking to a shop, payment link, or using the image to promote a business constitutes commercial use. See LICENSES & PRICING for full commercial license details and terms.- Private commissions: If the Client selects the "Private commission" option (as specified above), the Artist will not display the work in the Artist’s portfolio or galleries; the buyer will still receive a Personal license and the Artist will retain copyright.- Display & credit: If the Private commission option is not selected, the Artist may publish the work in the Artist’s portfolio or on social media. The same applies to non-exclusive commercial licenses. Credit is appreciated but not required. Exclusivity is available only via the High Commercial license (or a higher negotiated tier): exclusivity must be requested when ordering.


Licenses

SUMMARY: I keep the copyright unless a full buyout is negotiated and paid separately. Otherwise, buying a commission only gives you the license listed below (personal vs commercial). Exclusivity is available only if you pick the High Commercial tier or negotiate one above it.
LICENSES & PRICING- Personal:  TOTAL COMMISSION PRICE x 1 
Non-commercial use only. Personal social posts allowed. Linking to a shop, payment link, or using the image to promote a business counts as commercial.
- Small Commercial:  TOTAL COMMISSION PRICE x 1.5 
Estimated relevant gross revenue ≤ $60,000/year.
- Medium Commercial:  TOTAL COMMISSION PRICE x 3 
Estimated relevant gross revenue > $60,000/year and ≤ $300,000/year.
- High Commercial:  TOTAL COMMISSION PRICE x 6 
Estimated relevant gross revenue > $300,000/year and ≤ $1,500,000/year OR requested exclusivity for the 3-year term.

DEFINITIONS & SCOPE- Commercial use: Using the artwork to sell, promote, advertise, or otherwise generate revenue or leads (examples: product listings, paid ads, paid/monetized content, merchandise, in‑game paid assets).- Non-commercial use: Personal or non‑monetized use only (examples: personal social posts, private messages, free fan art).- Exclusive: The Artist will not license or sell the specific commissioned artwork to others for the 3‑year term. Exclusivity applies only to that artwork and is granted only if the Client specifically opts in on the High Commercial tier (or a higher negotiated tier). Portfolio or promotional display of the exact artwork during the exclusivity term is permitted only if explicitly agreed in writing.- Delivery: Final files are provided after full payment is received.- Territory: Worldwide.- Copyright: The Artist retains copyright in the commissioned artwork; purchased licenses do not transfer copyright unless a full buyout is negotiated and paid separately.- Scope limit: The license covers a single commissioned artwork and the uses permitted by the purchased tier. Ongoing/serial projects, games, merchandise runs, or requests for more than three related assets require separate negotiation.
LICENSE TERM CLAUSE- All commercial licenses are valid for 3 years from Delivery. The Artist may initiate renegotiation at or after expiry; if no renewal is agreed the Client must cease commercial use or obtain a new license.
REVENUE DISCLOSURE & VERIFICATION- Clients selecting a commercial tier must state the intended use(s) when ordering and disclose the relevant estimated gross revenue for the product/service that will use the artwork (recommended: last 12 months or expected next 12 months). "Relevant" means revenue tied to the item that will directly use the art, not unrelated income.- Acceptable proof (if requested): a platform dashboard screenshot, sales total, or payout summary showing account name and date. The Client must redact sensitive data before sending. The Artist will not retain unnecessary personal financial details.- If a Client cannot or will not provide figures when reasonably requested, the Artist may require payment at the next higher license tier relative to the tier selected or may decline the commission. The Artist will not conduct extensive audits.
ENFORCEMENT, REFUNDS, & MISREPRESENTATION- Payment and the Client’s tier selection together grant the license for the stated term and scope: the Client should keep a copy of the agreement (direct message or email) for records.- Payments are non‑refundable except in exceptional cases; cancellation before Delivery means the license was never granted. If a refund is issued after Delivery, the Client must delete all files and cease use; the Artist may request confirmation.- If a Client knowingly misrepresents revenue or uses the artwork commercially beyond the purchased tier, the Artist may require retroactive payment for the appropriate tier or require the Client to cease uses beyond the purchased license.
USE PERMISSIONS- The Client may crop, resize, and place the artwork in layouts consistent with the purchased use. Creating derivative works, sublicensing, or allowing third parties to modify the art requires written permission from the Artist.
OTHER- Requests for uses or placements beyond the High Commercial tier (including large manufacturing runs, major ad campaigns, or prolonged exclusivity) require separate negotiation and pricing.- All other rules are covered in the Terms and Conditions.
